Oregon Court Preliminarily Approves Class Action Settlement
St. Charles Health System; Over Unpaid Study Time Wages
Carol Lynn Giles v. St. Charles Health System, Inc., Case No. 6:13-cv-00019-AA
May 4, 2017
The U.S. District Court for the District of Oregon has preliminarily approved a $9.5 million
settlement of a class action filed against St. Charles Health System for alleged unpaid study time wages.
The class action lawsuit alleged that St. Charles failed to pay hourly caregivers regular and overtime wages for time spent outside their regular work hours preparing for the examination associated with various certifications required by St. Charles: namely, CPR/BLS, ACLS, PALS, ENPC, NRP, TNCC, TEAM, and S.T.A.B.L.E. The lawsuit further alleged that St. Charles failed to pay caregivers in this group who ended their employment their final paycheck wages within the time required by Oregon law.
The class action settlement covers current and former caregivers required to take these certifications who worked during December 12, 2005 and the present at St. Charles-Bend; St. Charles-Redmond; St. Charles-Madras; St. Charles-Prineville; Mountain View Hospital; Pioneer Memorial Hospital; and Air Life of Oregon.
By entering into this settlement, neither party concedes the merit of their position. The settlement will be administered by Epiq Class Action & Claims Solutions, Inc., of Beaverton. Written notice of the settlement and a Claim Form will be sent to the caregivers identified to date as belonging to the class, at the address located for each.
